Sunday Alcohol Sales Now Legal in Ulysses

Ulysses City Council passed Sunday Sales of Alcoholic Liquor Ordinance 1318, during their regular meeting November 9. 

The ordinance vote was initially tied with Council Members Terry Maas, Ken Warner and Caleb Woods voting in favor; and Mark Diaz, John Duran and Sam Guy voting against. 

At the meeting, Bene Garcia, co-owner of Kingpin’s was the one who initially presented the request to the council. 

“People need to engage in small town government,” Garcia said, “It’s crucial for the survival of Ulysses.”

Garcia said his motivation towards this change was due to individuals traveling to surrounding areas on Sundays, as well as having the potential for 53 Sundays of extra revenue, “Not just for Kingpin’s, but for other businesses in town.” 

The first Sunday to allow alcohol sales was January 29th. Since then, Garcia said there has been a large amount of gratitude from other individuals and businesses for being at the forefront of this change.

“Through the experience, I wanted to thank everybody who supported the effort,” Garcia said, “that was definitely appreciated.” 

According to Ulysses City Ordinance No. 1318, passed on November 9th, 2022: 

An ordinance authorizing Sunday sales of alcoholic liquor and cereal malt beverage in the original package and consumption of cereal malt beverage within the City of Ulysses, Kansas, and repealing any ordinances in conflict thereof.

Be it ordained by the governing body of the City of Ulysses, Kansas.

Section 1. Pursuant to K.S.A. 41-2704, the sale at retail of cereal malt beverage in the original package is allowed within a city in Kansas on any Sunday, except Easter, between the hours of no earlier than 9:00 a.m. and not later than 8:00 p.m. Chapter 3, Article 2, Section 213 (c) of Code for the City of Ulysses, Kansas is hereby amended as follows:

“(c) Except as provided by subsection (d), no cereal malt beverages may be sold or dispensed between the hours of 12:00 midnight and 6:00 a.m., or consumed between the hours of 12:00 midnight and 6:00 a.m., Monday through Saturday. On Sundays, except Easter, cereal malt beverages may be sold or dispensed between the hours of 11:00 a.m., and 8:00 p.m., and consumed between the hours of 11:00 a.m., and 8:00 p.m.” 

Section 2. Pursuant to K.S.A. 41-712, the sale at retail of alcoholic liquor in the original package may be allowed within a city on any Sunday, except Easter, between the hours of no earlier than 9:00 a.m., and not later than 8:00 p.m., Chapter 3, Article 3, Section 3-305 of Code for the City of Ulysses, Kansas is hereby amended as follows:

“3-305. SALE AT RETAIL HOURS, No person shall sell at retail any alcoholic liquor in the city subject to the following conditions:

(a) On the first day of the week, commonly called Sunday, alcoholic liquor shall only be sold from 11:00 a.m. and 8:00 p.m.

(b) Alcoholic liquor shall not be sold on Thanksgiving Day, Christmas Day, and Easter; and

(c) Alcoholic liquor may be sold between the hours of 9:00 a.m. to 11:00 p.m. Monday through Saturday unless specifically prohibited per section (b).
